Terms and Conditions
Last updated: November 2026
1. About us
These Terms and Conditions govern the production services offered by Jacaranda Films (Lenyan SA, tax ID 218090960012, registered address Convención Nº 1343, Escritorio 201, CP. 11.100 - Montevideo - Uruguay) through www.jacarandafilms.com ("Jacaranda Films", "we", "us").
Jacaranda Films is a service production company based in Argentina, Chile, Colombia and Mexico. We provide local production services to advertising agencies, production companies, brands and filmmakers who want to shoot in Latin America.
By requesting a quote or hiring our services, the client ("you", "the Client") accepts these Terms and Conditions. Where a signed agreement or approved quote contains different terms, that document prevails for the project concerned.
2. Our services
We offer production services for audiovisual projects shot in Latin America, including:
• Commercials and branded content, including our specialised lines Bloom (luxury brands) and Rustle (cars, motorbikes and trucks)
• Music videos
• Documentaries, short films and feature films
Depending on the project, our services may include location scouting, permits, casting, crew hiring, equipment rental, art department, logistics, accommodation and transport, local accounting, and on-set production management.
3. A personalised service
Every service we provide is tailor-made. We do not sell standard packages or fixed-price products online. The scope, budget and schedule of each project are defined with the Client according to their creative brief, shooting dates, locations and requirements.
4. How to hire our services
Our services cannot be purchased directly on this website. They are hired through the following process:
1. Enquiry. The Client contacts us through the contact form, email or phone, sharing the brief, script or treatment, intended dates and locations.
2. Assessment. We review the project and may hold calls to clarify the creative and technical requirements.
3. Quote. We send a detailed written quote (budget) setting out the scope of services, costs, schedule and payment terms. Quotes are valid for 30 days unless stated otherwise.
4. Approval. The project is confirmed once the Client approves the quote in writing and, where applicable, signs a production services agreement.
5. Advance payment. Pre-production begins once the agreed advance payment has been received.
6. Production. We carry out pre-production, the shoot and wrap, keeping the Client informed throughout.
7. Wrap and final settlement. After the shoot we issue the final cost report and invoice for any balance due.
5. Prices and payment
• Prices are set individually in each quote, in the currency stated there (usually US dollars or local currency), and exclude taxes unless indicated.
• Unless otherwise agreed, payment is made in instalments: an advance on approval (typically 50%), a further payment before/during the shoot (40%), and the balance on delivery of the final cost report.
• Payments are made by bank transfer to the account indicated on our invoice.
• Costs arising from changes requested by the Client after approval (extra shooting days, new locations, additional crew or equipment) are quoted and invoiced separately.
6. Changes, postponement and cancellation
• Any change to the approved scope must be agreed in writing and may modify the budget and schedule.
• If the Client postpones or cancels the project, costs already incurred and non-refundable third-party commitments (locations, crew, equipment, travel, permits) remain payable, together with any cancellation fees set out in the quote or agreement.
• Weather, government restrictions or other events beyond our control may require changes to the schedule. We will propose alternatives with the Client; resulting extra costs are handled as agreed in the quote.
7. Client responsibilities
The Client undertakes to provide accurate and timely information (brief, script, references, approvals), to hold the rights to the creative content supplied, and to make payments on the agreed dates.
8. Intellectual property
Unless otherwise agreed, the rights to the footage and creative work produced belong to the Client once all amounts due have been paid in full. Jacaranda Films may mention the project and use stills or excerpts in its portfolio, unless the Client requests confidentiality in writing.
9. Confidentiality
Both parties keep confidential all non-public information exchanged in connection with a project, including scripts, budgets and creative materials.
10. Liability and insurance
We perform our services with professional diligence and in compliance with local regulations. Production insurance is arranged as specified in each quote. Our liability is limited to the amount paid for the services concerned and does not extend to indirect losses.
11. Personal data
Personal data received through this website or during a project is used only to manage enquiries and provide our services, in accordance with applicable data protection laws.
12. Governing law
These Terms and Conditions are governed by the laws of Uruguay. Any dispute will be submitted to the courts of Montevideo, unless the project agreement provides otherwise.
